1About these terms

MYNIFEST® is a free goal and task tracker, operated by Jesus Agudo. In these terms, “MYNIFEST”, “we” and “us” mean Jesus Agudo, the operator. These terms cover the MYNIFEST app and this website.

By creating an account or using MYNIFEST, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use it.

2Who can use MYNIFEST

You must be at least 16 years old. If you are 16 or 17, you need a parent or guardian’s permission to use MYNIFEST.

When you sign up, you tick a box that says: “I am 18 or older, or I am 16 or 17 and have a parent or guardian’s permission.” You cannot create an account without it, and by ticking it you tell us it is true.

3Your account

You need an account to use MYNIFEST, and creating one is free. After you sign up, we email you a confirmation link that works for 3 days. Please confirm your email before you start using the app.

• Give us true details, and keep them up to date.
• Keep your password private. You are responsible for what happens on your account.
• If you think someone else has used your account, tell us through our contact form.

4Free to use

MYNIFEST is free to use. We do not charge you to create an account or to use the app. It is provided “as is”, which you can read more about in section 10.

5Your content

The goals, tasks, notes, checklists and other things you put into MYNIFEST are yours. We do not claim to own them.

You give us permission to store them and show them to you, and to let our administrators see them when they need to look after your account or help you, as our Privacy Policy explains. We do not use your content for anything else.

You are responsible for what you write. Please do not store anything you do not have the right to store.

6Download and delete

You can download your data as a CSV or JSON file in Settings at any time. You can also delete your account in Settings at any time. When you do, everything tied to your account is removed right away and cannot be brought back. Our Privacy Policy lists exactly what is removed.

We do not promise to keep backups of your content, so please download a copy of anything important.

7Using MYNIFEST fairly

Please do not:

• use MYNIFEST to break the law or to harm anyone;
• try to break into the service, or into another person’s account or information;
• try to overload, disrupt or damage the service or the systems it runs on;
• use it to harass anyone, or to store material that is unlawful;
• pretend to be someone else or give false details to sign up.

8Reminders are a nudge

Reminders and alerts are there to give you a friendly nudge. They are not a guarantee. An email or alert can arrive late or not at all, so please do not rely on MYNIFEST for anything urgent or anything to do with your safety or someone else’s.

9Changes and downtime

We may change, add or remove parts of MYNIFEST at any time. The service may also be down for a while, for repairs or updates, or because of something outside our control. We will try to keep interruptions short, but we cannot promise that MYNIFEST will always be available.

10No promises about the service

MYNIFEST is offered “as is” and “as available”. We take care in running it, but we cannot promise that it will be uninterrupted, on time, error free, or that it will meet your needs. We make no promises about uptime. Do not rely on MYNIFEST as the only place you keep something you cannot afford to lose.

11Pausing or closing accounts

We may pause or close an account that breaks these terms, puts the service or other people at risk, or if the law requires it. Where we reasonably can, we will tell you why. You can stop using MYNIFEST at any time by deleting your account in Settings.

12Limits of our responsibility

To the fullest extent the law allows, MYNIFEST and the people who run it are not responsible for any loss or damage that comes from using, or not being able to use, the service. This includes lost data, lost time and lost opportunities, and indirect or knock on losses.

Nothing in these terms limits any responsibility that the law does not allow us to limit.

13Changes to these terms

We may update these terms from time to time. When we do, we will change the “Last updated” date at the top. If a change is important, we will announce it in the app. If you keep using MYNIFEST after a change, you accept the updated terms.

14Governing law

These terms are governed by the laws of the State of North Carolina, USA.
